Accommodation Agreement/Terms of Use

Scope of the Terms and Conditions (Article 1)

1. Accommodation contracts entered into between the facility and guests and related agreements shall be governed by the provisions of these Terms and Conditions. Matters not stipulated in these Terms and Conditions shall be governed by laws or generally established customs.

2. If the facility agrees to a special agreement to the extent that it does not violate laws, regulations, and customs, the special agreement shall prevail, notwithstanding the provisions of the preceding paragraph.

Application for accommodation contract (Article 2)

1. A person who wishes to apply for an accommodation contract with this facility is required to provide the following information to this facility.
(1) Names of guests
(2) Dates of stay and expected time of arrival
(3) Mobile phone number and email address reachable on the day of arrival
(4) Accommodation fees
(5) Other matters deemed necessary by the facility

2. In the event that the guests request to continue their stay beyond the date of stay stipulated in item 2 of the preceding paragraph during their stay, the facility shall treat such a request as a new application for a contract of stay at the time the request is made.

Conclusion of Accommodation Contract, etc. (Article 3)

1. The accommodation contract shall be concluded when this facility accepts the application described in the preceding article. However, this does not apply if the facility can prove that it did not accept the request.

2. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, regardless of the length of stay, the room charge, cleaning fee, and accommodation tax must be paid by the date designated by the facility.

3. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, regardless of the length of stay, the room charge, cleaning fee, and accommodation tax must be paid by the date designated by the facility. The application fee shall first be applied to the accommodation fee that the guests are ultimately required to pay. In the event that circumstances arise to which the provisions of Articles 6 and 18 apply, the fee shall be applied in the order of penalty fees, followed by compensation, and any remaining balance shall be refunded when making payments according to the provisions of Article 12.

4. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, regardless of the length of stay, the room charge, cleaning fee, and accommodation tax must be paid by the date designated by the facility. In the event that the application fee stipulated in Paragraph 2 is not paid by the date designated by the facility in accordance with the provisions of the same paragraph, the accommodation contract shall cease to be effective.

Special Agreement Regarding Non-Requirement of Application Fee (Article 4)

1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the facility may agree to waive the payment of the application fee specified in the same paragraph after the conclusion of the contract.

2. When accepting the application for the accommodation contract, if the facility does not request payment of the application fee specified in Paragraph 2 of the preceding article and does not designate a payment deadline for the said deposit, it shall be treated as having accepted the special agreement in the preceding paragraph.

Refusal to Enter into an Accommodation Contract (Article 5)

1. The facility may refuse to enter into an accommodation contract in any of the following cases:

(1) When the application for accommodation is not in accordance with these Terms and Conditions.
(2) If the guests refuse to pre-register in the online guest list as required by the facility.
(3) When there are no rooms available due to full occupancy.
(4) When it is recognized that the person who intends to stay is likely to commit an act contrary to the provisions of laws and regulations, public order, or good morals in connection with the stay.
(5) When it is recognized that the person who intends to stay falls under any of the following items (a) through (c):

a. Organized crime groups as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Law No. 77, 1991) (“Organized crime groups”), organized crime group members prescribed in Article 2, Item 6 of the same Act (“organized crime group members”), and associate members of organized crime groups or persons related to organized crime groups, or other antisocial forces.
b. When the applicant is a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime group member.
c. A corporation in which any of its officers fall under an organized crime group member category.

(6) When a person intending to stay in the facility has engaged in behavior that significantly inconveniences neighboring residents or similar parties.
(7) When the person intending to stay is clearly recognized as being infected with a contagious disease.
(8) When violent demands are made regarding accommodation, or when demands are made that exceed a reasonable scope of burden.
(9) When it is not possible to provide accommodation due to natural disasters, facility malfunctions, or other unavoidable circumstances.

Cancellation of Accommodation Contract by Guests (Article 6)

1. Guests may cancel the accommodation contract by making a request to the facility.

2. If guests cancel all or part of the accommodation contract due to reasons attributable to them, the facility will charge a penalty fee as listed in Appendix 2. However, if the facility has agreed to the special agreement as per Article 4, Paragraph 1, the obligation of guests to pay a penalty fee upon cancellation of the accommodation contract will only apply if the facility has notified the guests of this obligation to pay a penalty fee at the time of agreeing to the special agreement.

3. The facility may treat the accommodation contract as canceled by the guests if the guests do not arrive by 8:00 p.m. on the day of stay (or two hours after the stated expected arrival time, if one was provided) without contacting the facility.

Cancellation of Accommodation Contract by the Facility (Article 7)

1. Even if an accommodation contract has been established in accordance with Article 3, Paragraph 1, the facility may cancel the contract if any of the following conditions apply:

(1) When it is determined that any of items (2) through (9) of Article 5 applies.
(2) When the facility determines that the rules of use stipulated in Article 10 have been or are likely to be violated.
(3) When it is recognized that there has been a refusal to register or false registration in the online guest register requested by the facility.
(4) In addition to the preceding items, when there is a justifiable reason for cancellation.

2. When the facility cancels the accommodation contract in accordance with the provisions of the preceding paragraph, it will not charge for any accommodation services or similar services that guests have not yet received.

Registration for Accommodation (Article 8)

1. Guests are required to register the following items in the online guest register by 3:00 p.m. on the day of their stay.

(1) Names, ages, addresses, and occupations of the guests
(2) For foreigners, nationalities, passport numbers, places of entry, dates of entry, and attachments of the images of passport ID pages are required.
(3) Dates of stay and expected time of arrival
(4) Other matters deemed necessary by the facility

2. When guests intend to pay the charges under Article 12 using methods other than currency, such as traveler’s checks, accommodation vouchers, credit cards, etc., they must present these at the time of registration mentioned in the preceding paragraph.

Room Usage Hours (Article 9)

1. Guests may use their rooms at the facility from 3:00 p.m. to 10:00 a.m. the following day.

However, in the case of consecutive stays, guests can use the room all day except for the day of arrival and the day of departure.

2. Notwithstanding the provisions of the preceding paragraph, the facility may accommodate the use of guest rooms outside the hours specified in the same paragraph. In this case, the facility will charge an additional fee as specified by the facility.

Compliance with Rules of Use (Article 10)

Guests must comply with the rules of use established and posted within the facility during their stay.

Business Hours (Article 11)

The facility’s business hours are as follows and may be temporarily changed in case of necessity or unavoidable circumstances. In such cases, notification will be made by appropriate means.

(1) Check-in time: 3:00 p.m. to 11:00 p.m.

Payment of Charges (Article 12)

1. The breakdown of accommodation charges, etc., payable by the guest and the method of calculation shall be shown in Appendix 1.

2. Payment of the accommodation fees mentioned in the preceding paragraph shall be made via currency or alternative methods accepted by the facility, such as traveler’s checks, accommodation vouchers, credit cards, etc., at the time of booking or when requested by the facility. Payment shall generally be made through online settlement or bank transfer.

3. Room charges shall apply if the guests choose not to stay voluntarily after the facility has provided the room to the guest and made it available for use.

The Responsibility of the Facility (Article 13)

1. The facility shall compensate the guests for any damages incurred due to the performance or nonperformance of the accommodation contract and related agreements. However, this shall not apply if the damages are not attributable to the facility’s fault.

2. The facility is insured against liability in case of unforeseen events, such as fires, through Hotel Liability Insurance.

Handling When the Contracted Room Cannot be Provided (Article 14)

1. In the event that the facility is unable to provide the guests with the contracted room, the facility shall seek the guests’ consent and endeavor to arrange alternative accommodation with similar conditions to the extent possible.

2. If, notwithstanding the provisions of the preceding paragraph, the facility is unable to arrange alternative accommodation at other lodging facilities, it shall compensate the guests with an amount equivalent to the penalty fee, and this compensation fee shall be applied towards the amount of damages. However, no compensation fee shall be paid if there is no fault attributable to the facility for the inability to provide the room.

Handling of Deposited Items, etc. (Article 15)

For items, cash, and valuables brought into the facility by the guests, it is the responsibility of the guests themselves to manage them. The facility shall not be liable for any loss, damage, or other harm that may occur to such items, cash, or valuables. However, the facility shall compensate for damages up to 150,000 yen only if there is intentional or gross negligence on the part of the facility.

Storage of Guests’ Luggage or Belongings (Article 16)

1. The facility will not accept deliveries on behalf of guests when they send luggage via courier services or similar means. Furthermore, the facility does not guarantee the shipping fees for returns or transfers due to the inability to receive the luggage.

2. After the guests have checked out, if any of their luggage or belongings are left behind at the facility, the facility shall generally wait for inquiries from the owners and seek their instructions. If there is no contact or instructions from the owners, the items will be disposed of after one month from the date of discovery (the following day for perishable items such as food, tobacco, magazines, damp cloth products, etc.).

3. In the case of the preceding two paragraphs regarding the storage of guests’ luggage or belongings, the responsibility of the facility shall follow the provisions of the preceding article in the case of the first clause and the provisions of Paragraph 2 of the same article in the case of the preceding paragraph.

Responsibility Related to Parking (Article 17)

If guests utilize the facility’s parking lot, the facility merely provides the space and does not assume responsibility for the management of the vehicles. However, the facility shall be held responsible for compensation if the damage is caused by intentional or negligent actions by the facility in the management of the parking lot.

The Responsibility of Guests (Article 18)

If the facility incurs damages due to the intentional or negligent actions of guests, the guests shall compensate the facility for such damages.

Disclaimer (Article 19)

When using Internet communication services within the facility, it is the responsibility of the guests to do so at their own risk. The facility shall not be liable for any damages incurred by the users due to the interruption of services caused by system failures or other reasons during the use of Internet communication services. Furthermore, in the event that damages occur to the facility or third parties due to actions deemed inappropriate by the facility during the use of Internet communication services, the user shall compensate for such damages.

Article 20 (Handling of Personal Information)

The facility shall strictly comply with relevant laws, regulations, contracts, and other norms concerning the protection of personal information. As a general rule, the facility does not disclose or provide personal information to third parties. When disclosing or providing information, we will do so appropriately in accordance with laws and regulations.

Article 21 (Jurisdiction and Governing Law)

Any disputes arising from contracts based on these Terms and Conditions and related agreements shall be resolved in accordance with Japanese law by the Japanese court having jurisdiction over the location of the operating company of the facility.

Appendix 1

The breakdown of accommodation fees (related to Article 2, Paragraph 1; Article 3, Paragraph 2; and Article 12, Paragraph 1) is as follows:

Note:

1. “%” represents the ratio of the penalty fee to the basic accommodation fee.
2. If the contracted period is shortened, regardless of the number of days shortened, the penalty fee for one day (the first day) will be charged.
3. In the case of certain accommodation products or group reservations organized by the facility where specific agreements are made separately, guests shall adhere to those agreements.

Rules of Use (House Rules)

At the facility, in order to ensure safety and provide guests with a comfortable stay, we have established the following rules of use in accordance with Article 10 of the Accommodation Agreement.

If you fail to abide by these rules of use, we reserve the right to refuse your stay and use of other facilities in accordance with Article 7 of the Accommodation Agreement. Additionally, we cannot accept any responsibility for accidents, incidents, or other issues arising from failure to comply with these rules of use. We appreciate your understanding.

1.Use of firearms and electrical appliances that generate high temperatures

At the facility, except for the provided facilities and equipment, please refrain from using personal heating, cooking appliances, irons, and similar devices. Additionally, please refrain from any other activities that may cause fire hazards.

2.Smoking in the facility

Smoking is strictly prohibited inside the facility. Please refrain from smoking outside of the designated outdoor areas. If you smoke in the house, you will be charged for the actual cost of cleaning bedding and rooms and other repairs.

3.Bringing in your own food and beverages

Guests are free to bring in items purchased by themselves from supermarkets, convenience stores, etc., and to consume them indoors. Please manage the items you bring in at your own responsibility.

4.Items that are prohibited from being brought in

The following items are strictly prohibited from being brought into the facility or premises.

  • Animals, birds (pets) ※Excluding assistance dogs (guide dogs, service dogs, hearing dogs)
  • Items that emit strong offensive odors
  • Explosives, volatile oils, and other flammable or combustible materials.
  • Firearms, swords, and other weapons not legally possessed.

5.No nuisance behavior is allowed

  • Please refrain from gambling and any actions or behavior that may disturb public order within the facility or cause inconvenience to our neighbors.
  • Please avoid singing, loud conversations, and the use of televisions or speakers at high volumes, or any other actions that may cause inconvenience to our neighbors.
  • Please do not remove, modify, or tamper with any equipment or facilities within the facility. Actual costs will be charged for any soiling, damage, or loss.
  • Please do not take photos or videos or stream live broadcasts using any devices for commercial purposes within the facility without permission.
  • If you are coming by car, please use the facility’s private parking lot. Please do not park illegally on the front or nearby streets or outside our premises.
  • Even if recorded privately, please do not post anything on the Internet or social media for commercial purposes without permission.
  • Please do not dispose of oversized garbage, household appliances, or other industrial waste that is not typically generated during a hotel stay.

6.Use of guest rooms

  • Please do not use the guest rooms for purposes other than accommodation.
  • Please do not use the guest rooms or other facilities as an office, showroom, or for filming commercial videos, or for any purpose other than accommodation.
  • Please refrain from distributing advertisements to other guests within the facility.
  • We do not allow visitors other than the guests (including companions) registered in accordance with Article 9 of the Accommodation Agreement to stay at the facility. Furthermore, should it be discovered that the number of guests exceeds the registered number, we will charge an additional penalty fee on top of the regular accommodation fee.
  • We do not provide accommodation to minors alone unless we have authorization from their legal guardians.

7.About locking up, security, and safety checks

  • Please make sure to check and lock the front door and windows when you go out during your stay.
  • For safety reasons, please turn off any electronic devices you bring with you when going out. Especially, avoid leaving devices equipped with mobile batteries or other rechargeable batteries charging unattended, as this may lead to fire.
  • Smoking is strictly prohibited inside the facility. Please refrain from smoking outside of the designated outdoor areas.
  • Please take care of your cash and valuables during your stay.

8.Handling of forgotten items

Forgotten items will be stored by the management company for a certain period from the day they are found, in accordance with the provisions of Article 16 of the Accommodation Agreement. After this period, they will be handled in accordance with the Lost Property Act. If you request the shipment of your forgotten items, the shipping costs will be at your expense.

9.Refusal to provide accommodation to organized crime groups and persons who cause significant nuisance to the facility or neighboring residents

We will refuse the use of the facility to any person who is suspected of offending public order and morals or any organized crime group, etc., as stipulated in Article 5, Paragraph 1, Items 4 and 5 of the Accommodation Agreement.


※If it is discovered after a reservation has been made or during your stay that you fall under the aforementioned categories, we will refuse service at that point, even if you are currently staying with us.
